Terms of Use for Dengar+

1. Acceptance of Terms

By downloading, installing, or using Dengar+, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the application.

2. Description of Service

Dengar+ is a meeting recording and transcription application that provides:

Audio Recording: Record meetings and conversations on your iOS device
AI Transcription: Convert audio to text using AI speech models (Google Gemini via OpenRouter)
Meeting Summaries: Generate intelligent summaries with key action items
Export Options: Share transcripts via PDF, DOCX, or other formats

3. Subscription Terms

3.1 Free Plan

Quota: 5 transcriptions (lifetime)
Cost: Free, no payment required
Features: Full access to recording, transcription, and summarization
Limitation: Quota never resets

3.2 Premium Subscription

Price: $4.99 USD per month (prices may vary by region)
Quota: 30 transcriptions per month
Reset: Quota resets on your subscription renewal date each month
Auto-Renewal: Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
Payment: Charged to your Apple ID account at confirmation of purchase
Management: Manage and cancel subscriptions in your App Store account settings

3.3 Subscription Cancellation

Cancel anytime via iOS Settings → [Your Name] → Subscriptions → Dengar+
Access continues until the end of the current billing period
No refunds for partial periods (handled by Apple’s refund policy)
Unused quota does not carry over or get refunded

4. User Responsibilities

By using Dengar+, you agree to:

4.1 Legal Compliance

Obtain necessary consent before recording any conversation
Comply with all applicable local, state, national, and international laws regarding recording and privacy
Respect the privacy rights of others

4.2 Acceptable Use

Use the service only for lawful purposes
Not record conversations where you don’t have permission
Not use transcripts for harassment, defamation, or illegal activities
Not attempt to reverse engineer, decompile, or modify the application

4.3 Account Security

Keep your Apple ID and device secure
Report any unauthorized access immediately
Take responsibility for all activity under your account

5. Intellectual Property

5.1 Your Content

You retain full ownership of your audio recordings
You retain full ownership of your transcripts and summaries
You grant us a limited license to process your audio for transcription purposes only

5.2 Our Content

Dengar+ app, including its design, features, and code, is owned by Dengar+ Team
You may not copy, modify, distribute, or create derivative works without permission
All trademarks and logos are property of their respective owners

6. Third-Party Services

Dengar+ uses the following third-party services:

OpenRouter and Google: For AI transcription and summarization (OpenRouter Terms, Google Terms)
Apple StoreKit: For in-app purchases and subscriptions (Apple Terms)
Hostinger: For backend infrastructure

By using Dengar+, you also agree to the terms of these third-party services.

7. Limitation of Liability

7.1 Service Provided “As Is”

Dengar+ is provided “as is” without warranties of any kind, either express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy of transcriptions

7.2 No Liability For:

Transcription errors or inaccuracies
Data loss or corruption
Service interruptions or unavailability
Actions taken based on transcripts or summaries
Any indirect, incidental, special, consequential, or punitive damages

7.3 Maximum Liability

Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Dengar+ Team from any claims, damages, losses, or expenses arising from:

Your use of the application
Your violation of these terms
Your violation of any third-party rights
Recording without proper consent

9. Termination

9.1 By You

You may stop using the app at any time
Delete the app to remove all local data
Cancel subscription via iOS Settings

9.2 By Us

We may terminate or suspend your access to the service:

For violation of these Terms
For fraudulent or abusive behavior
At our sole discretion with or without notice

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be communicated through:

Updated “Last Updated” date on this page
In-app notification for significant changes
Email notification if you’ve contacted us previously

Continued use of the app after changes constitutes acceptance of the new terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

12. Dispute Resolution

Any disputes arising from these Terms or your use of Dengar+ shall be:

First attempted to be resolved through informal negotiation
If unresolved, submitted to binding arbitration in Malaysia
Subject to the exclusive jurisdiction of Malaysian courts

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
